Resolution by the International Association of Security and Investigative
Regulators Concerning Harmful Security Consequences of Legislation Requiring that Criminal History Exchanges Not be Allowed on Arrest Data Without a Final Disposition on Arrests that are More than One Year Old

WHEREAS, the members of the International Association of Security and Investigative Regulators are responsible for the regulation of private security companies and private security officers according to the laws of the members’ respective states and provinces, and

WHEREAS, the regulation of private security is an integral component of public safety and security, and of the protection of the homeland, and

WHEREAS, proposed legislation has been introduced which prohibits the exchange of criminal history records or information about an arrest more than one year old as of the date of the request for the exchange, that does not also include a disposition (if any) of that arrest, and

WHEREAS, the reporting process by states and other jurisdictions may, due to the legal process, surpass a one year period for an individual awaiting trial for a violent felony, and

WHEREAS, the regulatory authority of a given state may approve a weapons license for an individual awaiting trial in another state if the criminal history exchange is prohibited without final disposition,

NOW, THEREFORE, BE IT RESOLVED:

As state regulators we utilize the FBI database of criminal histories to help determine the qualifications of individuals to carry weapons or to serve as security officers protecting the public.  It is critical that the records be both complete and accurate.  As Congress attempts to assure that the records are up to date and accurate, it is also essential that arbitrary time lines not be established that would result in dropping such records prior to their disposition.
